1. Acceptance of Terms

By accessing or using the Choply platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

Choply is an online food ordering and delivery platform that connects customers with local restaurants and independent delivery riders. We facilitate the ordering, payment, and delivery process but are not a party to the transaction between you and a restaurant.

3. User Accounts

• You must be at least 18 years old to create an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate, current, and complete information during registration.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorised use of your account.

4. Ordering and Payment

• All orders are subject to availability and restaurant acceptance.
• Prices are set by individual restaurants and may change without notice.
• Payment is processed securely through our payment partner (Paystack). We do not store your card details.
• Delivery fees and service charges are displayed before you confirm your order.

5. Delivery

• Estimated delivery times are approximate and not guaranteed.
• Choply and its partner riders will make reasonable efforts to deliver your order promptly.
• Risk of loss and title for items pass to you upon delivery.

6. Cancellations and Refunds

• You may cancel an order before the restaurant begins preparation.
• Refunds for issues with orders (missing items, quality, etc.) are handled on a case-by-case basis.
• Refunds are processed to the original payment method within 5–10 business days.

7. User Conduct

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to gain unauthorised access to any part of the Service.
• Harass, abuse, or harm delivery riders, restaurant staff, or other users.
• Provide false or misleading information.
• Use automated systems to access the Service without our written permission.

8. Intellectual Property

All content on the Choply platform — including logos, text, graphics, and software — is the property of Choply or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

9. Limitation of Liability

To the fullest extent permitted by law, Choply shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Service. Our total liability shall not exceed the amount you paid for the order in question.

10. Indemnification

You agree to indemnify and hold harmless Choply, its officers, directors, employees, and agents from any claims, losses, or damages arising from your use of the Service or violation of these Terms.

11. Modifications

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Service. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes shall be resolved in the courts of competent jurisdiction in Nigeria.
